1. General Information
These Terms and Conditions govern purchases made through the Hookloomkit website at https://www.hookloomkit.com.
Hookloomkit offers crochet hooks, knitting needle sets and related yarn craft supplies for customers in Europe. By placing an order, you agree to the terms set out below, subject to any mandatory rights and protections applicable under the law.
Brand Name: Hookloomkit
Website: www.hookloomkit.com
Email: crochet@hookloomkit.com
The business operator identified above is responsible for operating the website and managing customer orders.
2. Products and Product Information
We aim to provide clear and accurate descriptions of the products offered on our website, including relevant product specifications, available options, quantities and package contents.
Customers should review the relevant product page before placing an order to ensure that the selected items meet their requirements.
Product colours and visual appearance may vary slightly due to screen settings, lighting conditions and differences between individual items. Such variations do not affect any applicable statutory rights concerning goods that do not conform to the contract.
We may update product listings, prices and availability as our range changes. Any changes to an order already accepted will be handled in accordance with the applicable contract and mandatory law.
3. Orders and Contract Formation
Customers may select products, review their order and submit their purchase through the checkout process.
Before submitting an order, customers should check the selected products, quantities, delivery details, applicable charges and total payable amount.
Submitting an order constitutes an offer to purchase the selected products. The contract is formed in accordance with the order confirmation process stated at checkout and in the relevant confirmation communication.
We may contact customers where essential order information is incomplete or requires clarification. If an order cannot be accepted or fulfilled, any payment received for that unfulfilled order will be refunded as required by applicable law.
Customers are responsible for providing accurate contact and delivery information. If an error is identified, please contact crochet@hookloomkit.com promptly so that we can review whether a correction is possible before dispatch.
4. Prices and Payment
Prices and applicable delivery charges are displayed during the purchasing process. The total amount payable, including applicable taxes and delivery charges, will be shown before the order is submitted.
Payment must be completed using one of the payment methods made available at checkout.
Where Stripe processes a payment, the transaction is handled through the relevant payment processing arrangements. Payment status and transaction details may be used to confirm orders, process refunds and maintain required business records.
An order may be held for review where payment has not been confirmed or where further information is reasonably required to process the transaction.
5. Shipping and Delivery
5.1 Dispatch and Delivery Estimates
Orders are prepared for dispatch from Germany. We work with established carriers, including DHL, FedEx and UPS Priority services, as appropriate to the destination and shipment arrangement.
The estimated transit time is generally 5–12 business days, subject to the destination, carrier service and the circumstances affecting the shipment. Applicable delivery information displayed at checkout takes precedence for the relevant order where it specifies a different estimate.
Delivery estimates are provided to help customers plan their purchases. The actual delivery date may vary according to carrier operations, public holidays, local delivery arrangements and other circumstances affecting transport.
5.2 Tracking Notifications
Where tracking is available, we will send shipment-related email notifications to the email address provided at checkout. These notifications may cover key stages, including:
- Order dispatch.
- Arrival at a carrier facility or logistics point.
- Progress through the delivery network.
- Local delivery or an out-for-delivery update, where supplied by the carrier.
The availability and timing of individual tracking events depend on the information supplied by the carrier. Customers should check their inbox and spam or junk folder for shipment updates.
5.3 Delayed Shipments
If an order has not arrived within the applicable estimated delivery period, please contact crochet@hookloomkit.com with your order reference.
We will review the shipment information and, where appropriate, open an enquiry with the relevant carrier to establish the status of the parcel.
Following review of the available information, we will arrange an appropriate resolution. Depending on the circumstances and the outcome of the enquiry, this may include a replacement shipment or a refund.
Where the goods have not been delivered, we will comply with applicable statutory delivery obligations. A carrier enquiry will not remove any rights that the customer has under mandatory law.
5.4 Risk and Delivery
The risk of loss of or damage to the goods remains with Hookloomkit until the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods, except where a different rule lawfully applies under mandatory legislation.
Handing a parcel to a carrier does not, by itself, transfer the risk of loss or damage to the customer.
Customers should contact us promptly if a parcel appears to be missing or if the delivered goods have arrived damaged.
6. Right of Withdrawal
6.1 Statutory Withdrawal Period
Consumers purchasing online generally have the right to withdraw from a distance contract without giving a reason within 14 days.
For a contract involving the sale of goods, the withdrawal period normally expires 14 days after the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
Where an order consists of multiple goods delivered separately, or a product is delivered in multiple lots or pieces, the applicable withdrawal period is determined in accordance with the relevant statutory rules.
6.2 How to Exercise the Right
To exercise the right of withdrawal, please send a clear statement of your decision to withdraw from the purchase to:
Email: crochet@hookloomkit.com
Please include your order reference and the products concerned. You may use the model withdrawal form provided below, but its use is not compulsory.
To meet the withdrawal deadline, it is sufficient to send your withdrawal communication before the 14-day period expires.
6.3 Return of Goods Following Withdrawal
After notifying us of your withdrawal, you must send the goods back or hand them over to us without undue delay and no later than 14 days from the day on which you informed us of your decision to withdraw, unless we have offered to collect the goods or another statutory rule applies.
Please contact us before returning an item so that we can provide the appropriate return instructions and return address.
Unless we have agreed otherwise or applicable law requires us to bear the cost, the consumer is responsible for the direct cost of returning goods following a change-of-mind withdrawal, provided the required information about return costs has been supplied before the purchase.
Consumers may handle and inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning. Where handling goes beyond what is necessary and results in a diminished value, the consumer may be liable for that diminished value in accordance with applicable law.
Nothing in this section limits any statutory rights concerning defective or non-conforming goods.
6.4 Refunds Following Withdrawal
If you withdraw from a purchase, we will reimburse payments received for the relevant goods, including the cost of the least expensive standard delivery option offered at the time of purchase, where required by law.
We may withhold reimbursement until we have received the returned goods or you have supplied evidence that the goods have been sent back, whichever occurs first, unless we have offered to collect the goods.
Refunds will be made without undue delay and within the statutory period, normally no later than 14 days after we are informed of your decision to withdraw, subject to the lawful withholding rule above.
The refund will be made using the original payment method unless you expressly agree otherwise. No additional fee will be charged for the reimbursement.
6.5 Exceptions
The statutory right of withdrawal does not apply to every type of purchase. Any exception will apply only where the relevant statutory conditions are met.
Where an exception is applicable to a particular product or order, the information will be provided as required by law before the purchase is completed.
7. Damaged, Defective or Incorrect Goods
We want customers to receive the products they ordered in the condition required by the contract.
If your order arrives damaged, contains a defective item or does not correspond to the product ordered, please contact crochet@hookloomkit.com and provide:
- Your order reference.
- A brief description of the issue.
- Clear photographs showing the affected item and, where relevant, its packaging.
Photographs help us assess the reported issue and determine the appropriate next steps.
Where the evidence reasonably establishes that an item arrived damaged or is otherwise eligible for the requested remedy, we may arrange a refund or replacement without requiring the damaged item to be returned.
If further examination or other information is reasonably necessary, we will explain the next steps. Any request to return an item will be handled in accordance with applicable law, including the rules on remedies for defective or non-conforming goods.
Customers are not required to pay return costs that the law places on the seller.
The availability of a refund, replacement, repair, price reduction or other remedy depends on the circumstances and the applicable statutory rules. Nothing in this section limits mandatory rights relating to defective goods.
8. Refund Processing
Once a refund has been approved, it will normally be issued to the original payment method.
The time required for the refunded amount to appear in the customer’s account may depend on the payment method and the relevant financial institution.
For withdrawal requests, the statutory refund deadlines and permitted withholding rules in Section 6 apply. For damaged, defective, missing or incorrect goods, the applicable resolution and timing will depend on the circumstances and relevant legal requirements.
If you have questions about a refund, please contact crochet@hookloomkit.com and provide your order reference.
9. Customer Responsibilities
Customers should provide accurate information when placing an order and review the product details, quantities, delivery address and total amount payable before completing the purchase.
Customers should also retain their order confirmation and relevant correspondence until the order has been completed and any related matters have been resolved.
The website must not be used for unlawful activities, fraudulent orders, deliberate misuse of the ordering process or conduct that interferes with the operation of the website or the rights of others.
Where there is a reasonable basis to suspect unlawful activity or misuse, we may review the relevant order, request information necessary to resolve the issue or take other proportionate steps permitted by applicable law. Any action affecting an existing contract will remain subject to mandatory legal requirements.
10. Liability
Nothing in these Terms and Conditions excludes or restricts liability where such exclusion or restriction is prohibited by applicable law.
In particular, these Terms do not exclude liability for intent, gross negligence, injury to life, body or health where such exclusion is prohibited, or any other liability that cannot lawfully be limited.
Subject to the foregoing, we are responsible for fulfilling our contractual obligations in accordance with the applicable contract and law.
We are not responsible for delays or failures caused by circumstances beyond our reasonable control to the extent that applicable law permits such limitation. This provision does not transfer the risk of loss or damage to the goods to the customer before the applicable statutory point of delivery.
11. Complaints and Dispute Resolution
If you have a concern about a product, order, delivery or refund, please contact us first at crochet@hookloomkit.com and include your order reference and a description of the issue.
We will review the information provided and seek to address the matter appropriately.
Nothing in these Terms prevents a consumer from exercising a statutory right to bring a claim before a competent court or to use an applicable dispute resolution procedure available under law.
Any mandatory jurisdictional rules protecting consumers remain unaffected.
12. Governing Law
These Terms and Conditions are governed by the laws of Germany, subject to mandatory consumer protection provisions applicable in the consumer’s country of habitual residence where those provisions apply.
Where a consumer is entitled under applicable European Union law to the protection of mandatory provisions that would otherwise apply, this choice of law does not deprive the consumer of that protection.
The competent courts shall be determined in accordance with applicable jurisdiction rules, including any mandatory rules protecting consumers.
13. Changes to These Terms
We may revise these Terms and Conditions when our business arrangements, product range or applicable legal requirements change.
The current version will be published on our website with its revision date. Changes will not retrospectively remove contractual rights already acquired by customers, and any changes affecting an existing contract will be handled in accordance with applicable law.
